This privacy policy describes how Sri Gupta Drug Mart (the Business, we, our) handles personal and business information collected through customer and trade interactions, telephone and WhatsApp correspondence on +91 99660 39125, and any digital channels operated by the Business. It applies to individual customers as well as authorised contacts of pharmacies, hospitals and other counterparties.
We collect: (a) identity and contact information such as name, address, telephone and email, and, for trade counterparties, organisation and statutory identifiers (GSTIN, drug-licence number); (b) prescription and order information including the medicines requested and any prescription details necessary to fulfil the order; (c) commercial information including order history, invoices and payment references; and (d) product-quality information voluntarily reported in connection with a complaint.
Information is processed on the lawful bases of contract performance, statutory obligation under Indian pharmaceutical and tax law, and legitimate business interest in operating a compliant pharmacy and supply business. Purposes include order fulfilment, invoicing, prescription verification, regulatory reporting and protection against fraud.
We share information with: (a) statutory and regulatory authorities where disclosure is required by law; (b) authorised logistics and payment partners strictly to perform a service requested; (c) professional advisers under appropriate confidentiality obligations. We do not sell personal information.
We retain information for the period required to satisfy the purposes above and to comply with applicable record-keeping obligations under the GST regime and the Drugs and Cosmetics Act. On expiry of that period, records are securely deleted or anonymised.
We apply administrative, technical and physical safeguards proportionate to the sensitivity of the data, including access control and incident-response procedures. No transmission method is perfectly secure; we ask customers and counterparties to apply equivalent diligence on their side.
Subject to applicable law, you may request access to, correction of, restriction on, or deletion of personal information we hold about you. We will respond within a reasonable timeframe, subject to verification of identity and any overriding statutory record-keeping obligation.
This policy may be updated from time to time; the effective version is the one published on the Business's website. It is governed by Indian law, and the courts at Hyderabad, Telangana have exclusive jurisdiction over any dispute arising in connection with it.
The terms below govern access to and use of the Business's website, communications and ordering-channel interactions. By engaging with the Business, the customer or counterparty accepts these terms.
'Business' means Sri Gupta Drug Mart, a partnership between Nisha Agarwal and Umang Agarwal (GSTIN 36AFLFS9429P1ZW), having its registered office at Bandimet, Hyderabad, Telangana. 'Customer', 'Counterparty', 'you' or 'your' means any individual, pharmacy, hospital or entity engaging with the Business. 'Goods' means pharmaceutical products and consumables supplied by the Business.
Trade orders may be placed only by entities holding a valid drug licence and other applicable statutory registrations. Individual customers may place retail orders subject to a valid prescription where the product requires one. The Business reserves the right to verify documentation and to decline or discontinue dealings where verification is not satisfied.
An order placed through accepted channels constitutes an offer to purchase. The Business's acceptance occurs on dispatch confirmation; until that point, the Business may decline an order in whole or in part. Prices are exclusive of taxes unless stated; applicable GST is charged on every invoice. The Business may revise prices for future orders without notice.
Payment is due against the terms communicated at order acceptance — on delivery, in advance, or on agreed credit for trade partners. Outstanding trade amounts beyond the agreed period may attract interest at the rate notified, suspension of further dispatch, and recovery proceedings under applicable law.
Risk in the Goods passes on delivery to the customer or counterparty, or to a logistics partner nominated by them. Title in the Goods remains with the Business until full payment is received. Acceptance is deemed unless a written discrepancy notice is served within the timeframe set out in the Refund & Returns Policy.
Scheduled and prescription-only medicines are dispensed only against a valid prescription in line with the Drugs and Cosmetics Act and applicable rules. Trade counterparties undertake to handle, store and resell Goods in compliance with the same regulatory framework, including cold-chain requirements where stated.
All trademarks, brand elements and digital assets remain the exclusive property of the Business or its licensors. Reproduction, adaptation or commercial reuse without prior written consent is prohibited.
Subject to applicable law, the Business's aggregate liability arising out of or in connection with any single order shall not exceed the invoice value of that order. The Business shall not be liable for indirect, incidental, consequential or punitive damages, except where such limitation is excluded by mandatory statute.
Neither party is liable for delay or failure caused by events outside reasonable control — including natural disaster, public-health emergency, regulatory action, transport disruption or supply-chain failure — provided notice is given and reasonable mitigation undertaken.
These terms are governed by the laws of India. The courts at Hyderabad, Telangana have exclusive jurisdiction over any dispute, claim or proceeding arising out of or in connection with these terms or any transaction governed by them.
Pharmaceutical returns are tightly regulated for patient-safety reasons. The terms below describe the limited circumstances under which returns are accepted and how refunds are processed.
As a regulated pharmaceutical supplier, the Business does not accept returns of correctly supplied Goods on grounds of changed buying preference. Returns are limited to the scenarios below and are subject to verification.
Returns are eligible where: (a) Goods were supplied in error against the confirmed order; (b) Goods were damaged in transit or on delivery; (c) Goods were received with a manufacturing defect or short shelf-life inconsistent with the order; or (d) a regulatory recall has been initiated.
Discrepancies under heads (a) and (b) must be notified within seven (7) calendar days of receipt with photographic evidence and the original invoice. Defects under head (c) must be notified within thirty (30) calendar days of receipt, or within seven (7) days of detection where the defect could not reasonably have been found earlier.
Returned Goods must be in original primary and secondary packaging, with intact batch and expiry information, free of any tampering or relabelling, and accompanied by the relevant invoice number.
Vaccines and other cold-chain products are accepted for return only where temperature integrity throughout the chain can be evidenced. A cold-chain breach disqualifies a return regardless of physical condition.
Approved returns are credited against future invoices, or refunded to the originating payment source at the Business's discretion, within fourteen (14) working days of acceptance of the returned Goods. GST adjustments are processed through a compliant credit note where applicable.
Any dispute regarding a return or refund shall be raised in writing to the registered office. Unresolved disputes are subject to the exclusive jurisdiction of the courts at Hyderabad, Telangana, and governed by Indian law.
How orders accepted by the Business are processed, dispatched and delivered to customers and trade partners.
Home delivery is offered locally within our serviceable area, and pan-India courier & distribution is available for orders that need to travel further, subject to product suitability. Serviceability for a specific location is confirmed at order acceptance.
Confirmed local orders are typically packed and dispatched within same day to two (2) working days of acceptance; pan-India orders follow standard courier timelines. Both are subject to product availability.
Local deliveries are handled directly or through our home-delivery arrangements; longer-distance orders are dispatched through logistics partners selected for pharmaceutical handling capability.
Temperature-sensitive Goods, including vaccines, are dispatched under conditions appropriate to the product label. The recipient is asked to inspect the consignment on receipt and flag any concern before storing the product.
On delivery, the recipient should inspect the consignment for correctness and visible damage and report any discrepancy promptly. Acceptance without objection is treated as acknowledgement of correct delivery.
Delivery charges, where applicable, are stated at order acceptance and itemised on the invoice. Bulk and trade orders may follow separately agreed logistics terms.
Where delivery cannot be completed because the recipient is unavailable or refuses receipt, Goods are returned to the store; re-dispatch attracts further charges, and short-shelf-life Goods may be quarantined.
Dispatch and shipping queries are routed through +91 99660 39125 on voice or WhatsApp. Unresolved escalations may be addressed in writing to the registered office at Bandimet, Hyderabad.
